The mission of the Cherokee County Probate Court is to provide professional and compassionate assistance to the public through an unbiased and responsive justice system.

The Probate Court has jurisdiction over the administration of decedents’ estates, the issuance of marriage licenses, the appointment of guardians and conservators, and involuntary commitments. The Probate Judge is elected countywide and serves a four-year term.

A majority of the matters administered in Probate Court are done so informally. However, some complicated and/or contested matters are considered formal actions. As the Probate Court must remain unbiased, the Probate Judge and Clerks cannot assist you with formal actions. The Probate Court strongly recommends that you hire an attorney to assist you with formal actions.

Probate Court Forms are available under the “Probate Court” tab at https://www.sccourts.org/forms/.

Certified Copies of Marriage Licenses filed from 1988 to present day are available for purchase online under the “Cherokee” dropdown option at www.southcarolinaprobate.net/search. You may also search open estate cases with this link.

Copies of Marriage Licenses filed before 1988 must be requested by mail. Mail your request with a $5 certified check or money order and a self-addressed, stamped envelope to Probate Court, P.O. Box 22, Gaffney, SC 29342. We cannot accept personal checks and do not recommend you send cash.
